Please carefully read these Terms of Use ("Terms") before using the Dyno Route mobile or web application ("App") and the associated services provided by Dyno Route ("Service"). By accessing or using the App and Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access or use the App and Service.

  1. App and Service Overview
    • Dyno Route provides route optimization services for solo drivers who visit multiple addresses for parcel delivery and other services.
    • To create an account, you must sign up using your email, Google, or Apple credentials. Please note that you must be 18 years or older and have the necessary authority to enter into this agreement.
    • You may not use the Services for any illegal or unauthorized purpose, including but not limited to: propagation of violence, hate speech, harassment, distribution of malware, phishing, spam, infringement of intellectual property rights, or fraud. Dyno Route reserves the right to determine whether your use of the Services falls under unauthorized purposes.
  2. Account Creation and Eligibility
    • To use our Service, you must create an account using your email, Google, or Apple credentials. Please note that you must be 18 years or older and have the necessary authority to enter into this agreement.
    • Your account access and usage are limited to the specified number of individual users mentioned on our website. Each user should have a unique login using usernames and passwords, which should not be shared.
    • Your account must be registered by a human. Accounts registered by "bots" or other automated methods are not permitted.
    • You are responsible for maintaining the security of your account, password, and other safeguards, such as two-factor authentication. Dyno Route cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
  3. Subscription and Payment
    • We offer a pay-as-you-go model for our Service. There are no monthly or yearly auto-renewing subscriptions. You can purchase credits, which will never expire, and use them based on your needs. The number of credits deducted depends on the number of stops in your route. Please refer to our pricing details on our website for more information.
    • Your access and use of the Service are subject to the payment of applicable charges based on the subscription plan and pricing listed on our website. Credit purchases are due in full and payable in advance upon subscribing to the Service. Please note that all credit purchases are non-refundable, and no refunds will be issued for partial or non-use of the Service.
    • All payments for the Services must be made online with a valid credit card or through Apple's in-app purchase or Google Play. Accounts on our Free plan do not require a credit card to use the Services.
    • If you have made a payment through Apple's in-app purchase or Google Play, any refund requests should be directed to Apple or Google, respectively, as they handle the billing and refund process for in-app purchases. We are unable to process refunds for payments made through these platforms.
    • For payments made directly through our website, please note that all fees published are exclusive of all taxes, levies, or duties imposed by taxing authorities. We may collect taxes on behalf of taxing authorities in some jurisdictions, meaning your invoices may include additional line items for federal and/or state taxes. Other customers are responsible for payment of all taxes, levies, or duties as required.
    • We reserve the right to modify the Service or prices at any time. We will aim to notify you in advance of any material changes.
  4. Your Responsibilities and Acceptable Use
    • Your Account: You are responsible for maintaining the confidentiality of your account credentials and ensuring that your account information is accurate and up to date.
    • Acceptable Use: You agree to use the Service responsibly and in compliance with these Terms. This means you should not sell, sublicense, distribute, or misuse the Service. Additionally, you should not use the Service for storing or transmitting sensitive personal information or violate any applicable laws or regulations. We expect you to respect intellectual property rights and avoid posting or transmitting any harmful or unlawful content.
  5. Service Availability and Updates
    • We strive to provide uninterrupted access to our Service. However, due to scheduled maintenance or circumstances beyond our control, the Service may be temporarily unavailable. We will make reasonable efforts to notify you in advance. We may also deploy updates or new features to improve the Service, and these updates will be subject to these Terms.
  6. Intellectual Property Rights
    • We own all intellectual property rights related to the Service, including patents, copyrights, trademarks, and trade secrets. You retain ownership of the data you provide to us (Customer Data), and we respect your rights. However, we may use your feedback to improve our Service or incorporate your suggestions into future updates. You may not duplicate, copy, or reuse any portion of the App's design or visual elements without express written permission.

  7. Third-Party Services
    • Our Service may integrate with third-party applications or services through APIs. Your use of such third-party services will be subject to their terms and privacy policies. We are not responsible for any data processed by those third parties, and you should contact them directly for any issues related to their services.
  8. Cancellation, Term, Termination, and Suspension
    • You are solely responsible for properly canceling your account. Cancellations take effect immediately or you can contact us on support@dynoroute.com for deleting your information or questions regarding cancellations.
    • The Subscription Term will be specified on our website. You have the right to terminate your Account if we materially breach these Terms, subject to providing us advance notice and a reasonable opportunity to cure the breach. We may also suspend or terminate your Account if you violate these Terms or fail to cure any breach within the provided notice period. Upon termination, your access to the Service will cease, and we may delete your data after a specified retention period.
  9. Confidentiality, Data Privacy, and Security
    • We respect the confidentiality of your data and will protect it in accordance with applicable laws and regulations. We will use appropriate technical and organizational measures to secure your data. Please review our Privacy Policy for more details on how we handle your data and ensure its privacy and security.
  10. Disclaimer of Warranties and Limitation of Liability
    • The Service is provided on an "as is" and "as available" basis. We do not provide any warranties, express or implied, regarding the Service's availability, security, or fitness for a particular purpose. We will not be liable for any damages, including indirect, incidental, or consequential damages, arising from your use of the Service.
    • Dyno Route will not be liable to you or any third party for any direct, indirect, incidental, special, exemplary, or consequential damages, lost profits, lost data, business interruption, or other intangible losses resulting from the use or inability to use the Services.
  11. Indemnification
    • You agree to indemnify and hold us harmless from any claims or damages arising from your acts or omissions in connection with these Terms. We will cooperate with you in defending against such claims.
  12. Governing Law
    • Your use of the Services and these Terms shall be governed by and interpreted in accordance with the laws of Arizona, USA, without regard to principles of conflicts of laws. Any disputes arising from or related to your use of the Services shall be subject to the exclusive jurisdiction of the courts in Arizona, USA.
  13. Miscellaneous
    • These Terms constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. We may update these Terms from time to time, and your continued use of the Service after the changes will indicate your acceptance of the revised Terms.
